How can anyone who has taken an oath to uphold and defend the Constitution vote to approve someone like Elena Kagan for the Supreme Court?
When she was asked what should be a simple question, she gave a long drawn out "legalese" answer.
Sen. Tom Corban basically asked if Congress could pass a law requiring Americans to eat fruits and vegetables. Kagan at first said "that would be a dumb law". She didn't get it. I don't know specifically why he asked her that question, but I have to think it was because a case will hit the Supreme Court in the next decade, unless Congress can repeal Obamacare in the next couple of years, where the question will be "Can Congress pass a law requiring Americans to buy health insurance?"
The answer should have been to both questions...No Way can Congress pass a law that will require Americans to buy ANY products. It would be a very unconstitutional law.
She didn't say that because I believe that she thinks that the courts should legislate from the bench and that government is there to control the populist. She is very wrong, but unfortunately will probably be on the Supreme Court for a long time.
